Welcome to Corkys Coffee (“Corkys,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of CorkysCoffee.com (the “Site”) and any purchases, subscriptions, or services offered through the Site.

By accessing our Site or purchasing from us, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

1. Eligibility

By using this Site, you represent that you are at least 18 years old or the age of majority in your jurisdiction, and that you have the legal capacity to enter into these Terms.

2. Products & Services

Corkys Coffee sells roasted coffee, merchandise, vinyl records, subscriptions, and related goods.

All products are subject to availability. We reserve the right to discontinue or modify products at any time without notice.

3. Pricing & Payment

All prices are listed in U.S. dollars unless otherwise stated. We reserve the right to change prices at any time.

By placing an order, you authorize us (or our third-party payment processors) to charge your payment method for the full amount of your purchase, including applicable taxes and shipping.

4. Subscriptions

If you purchase a subscription (including coffee or vinyl subscriptions):

• Your subscription will renew automatically at the frequency you select (weekly, bi-monthly, monthly, etc.).

• Your payment method will be charged automatically unless you cancel prior to the renewal date.

• You may manage or cancel your subscription through your account dashboard or by contacting customer support before your next billing cycle.

We are not responsible for missed cancellation deadlines.

5. Shipping & Delivery

Shipping times are estimates and not guaranteed. We are not responsible for delays caused by carriers, weather, or events beyond our control.

Risk of loss passes to you upon delivery to the carrier.

6. Returns & Refunds

Due to the perishable nature of coffee, all coffee sales are final unless the product arrives damaged or incorrect.

Merchandise and vinyl may be eligible for return under our Return Policy, which is posted separately on the Site and incorporated by reference into these Terms.

7. Intellectual Property

All content on this Site—including logos, designs, product names, images, text, audio, and video—is owned by or licensed to Corkys Coffee and is protected by intellectual property laws.

You may not reproduce, distribute, or exploit any content without our prior written consent.

8. User Conduct

You agree not to:

• Use the Site for any unlawful purpose

• Attempt to interfere with the Site’s operation or security

• Submit false or misleading information

• Infringe upon our intellectual property or the rights of others

We reserve the right to suspend or terminate access for violations of these Terms.

9. Third-Party Services

Our Site may include links to third-party websites or services. We are not responsible for the content, policies, or practices of any third party.

10. Disclaimer of Warranties

All products and services are provided “as is” and “as available” without warranties of any kind, express or implied.

We do not guarantee that the Site will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, Corkys Coffee shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products.

Our total liability shall not exceed the amount you paid for the product giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Corkys Coffee and its owners, employees, and partners from any claims, damages, or expenses arising from your use of the Site or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict-of-law principles.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use constitutes acceptance of the updated Terms.

15. Black Friday/Cyber Monday Offer Terms

All Black Friday/Cyber Monday (“BFCM”) offers are subject to change or cancellation at any time without notice. Discounts apply only to eligible items as indicated and may not be combined with other promotions unless explicitly stated. Exclusions, pricing, and availability may vary by product and may be updated throughout the promotional period. Offers are valid only during the stated dates, while supplies last, and have no cash value. Subscriber discounts require a registered and logged-in account. Corkys reserves the right to limit quantities, modify or discontinue any promotion, and to revoke discounts in cases of suspected abuse or misuse. Additional terms may apply.

16. Free Shipping On Domestic Orders Over $75

Offer valid beginning January 1st, 2025 for a limited time on all approved orders equaling $75.00 or more placed online at our website, CorkysCoffee.com To qualify, orders must be shipped within the US via standard service. Order total is calculated after all discounts. Discount will be taken automatically at checkout. Not valid on previous orders. Other restrictions may apply.

17. PREORDERS

All preorders are charged at the time of purchase.

Estimated ship dates are listed on the product page but are subject to change due to production schedules, shipping delays, or other unforeseen issues. If anything shifts, we’ll do our best to keep you informed.

Preorders are non-refundable unless otherwise stated. Cancellations may be considered on a case-by-case basis if requested before the item ships. Once an item has shipped, our standard Return Policy applies.

If your order includes both preorder and in-stock items, the full order may be held until the preorder item is ready to ship. To receive in-stock items sooner, please place a separate order.

Preorder quantities are limited and available while supplies last. We reserve the right to cancel or adjust orders in the event of undersells, oversells, misprints, or supplier issues. If that happens, you’ll be notified and fully refunded.

18 - “Affiliate” Program

The Corkys “Affiliate” program allows customers to earn money for each sale through their cusom link. It is open to any user. Valid subscribers are those that have used the referral link or coupon associated with the referrer's account and have completed their purchase with a confirmed payment. By using the Corkys “Affiliate” program through CorkysCoffee.com, you are agreeing to be bound by the following terms and conditions. Violation of any of the terms below will result in the termination of your account. 

1. You must provide a valid email address, and any other information requested in order to complete the signup process. 

2. You must be a human. Accounts registered by “bots” or other automated methods are not permitted.

3. You are responsible for maintaining the security of your account and password. Corkys cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

4. You are responsible for all Content posted and activity that occurs under your account.

5. You may not use the “Affiliate” program for any illegal or unauthorized purpose. You must not, in the use of the “Affiliate" program, violate any laws in your jurisdiction (including but not limited to copyright laws).

6. Corkys in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the “Affiliate” program and its rewards. Corkys reserves the right to refuse participation in the program to anyone for any reason at any time. 

7. Corkys reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the “Affiliate” program with or without notice.

8. Your payments are routed through PayPal. You are expected to comply with the PayPal Acceptable Use Policy.

9. Your use of the “Affiliate” program is at your sole risk. The service is provided on an "as is" and "as available" basis.

10. You understand that Corkys uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the “Affiliate” program.

11. We may, but have no obligation to, remove content and accounts containing content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
